SENATE BILL 361

 

 

AN ACT to authorize the wildlife resources commission to temporarily waive the enforcement of no-wake zones under special circumstances.

 

The General Assembly of North Carolina enacts:

 

SECTION 1.  Article 1 of Chapter 75A of the General Statutes is amended by adding a new section to read:

"§ 75A-14.2.  Temporary waiver of enforcement of no-wake zones.

The Wildlife Resources Commission may temporarily and conditionally waive enforcement of a no-wake zone upon petition by a unit of local government that encompasses or abuts the no-wake zone if, after investigation of the reasons given for the temporary and conditional waiver, the Commission determines that public safety and the public welfare will not be significantly compromised by the waiver."

SECTION 2.  This act is effective when it becomes law.

In the General Assembly read three times and ratified this the 9th day of May, 2007.
