SENATE BILL 271

 

AN ACT TO REMOVE THE SUNSET ON FUEL COST ADJUSTMENT FOR ELECTRIC UTILITIES.

 

The General Assembly of North Carolina enacts:

 

Section 1.  Section 2 of Chapter 129 of the 1991 Session Laws is repealed.

Sec. 2.  Section 3 of Chapter 129 of the 1991 Session Laws reads as rewritten:

"Sec. 3.  On July 1, 1993 and every two years thereafter, the Utilities Commission shall provide a report to the Joint Legislative Utility Review Committee summarizing the procedures conducted pursuant to G.S. 62-133.2 during the preceding two years years. and recommending whether this section should be continued, repealed, or amended.  The Joint Legislative Utility Review Committee shall report to the General Assembly beginning with the 1994 Regular Session and every two years thereafter which report shall contain the information provided by the Utilities Commission and the Committee's recommendation whether G.S. 62-133.2 should be continued, repealed, or amended."

Sec. 3.  This act is effective upon ratification.
