SENATE BILL 177

AN ACT TO EXTEND THE ENERGY POLICY FOR STATE AGENCIES CONCERNING CONSTRUCTION OF BUILDINGS OR RENOVATION OF MAJOR BUILDINGS TO COMMUNITY COLLEGE FACILITIES.

The General Assembly of North Carolina enacts:

Section 1.  G.S. 143-64.11(7) reads as rewritten:

"(7)      The term 'State agency' means the State of North Carolina or any board, bureau, commission, institution, or other agency of the State, or any board or governing body of a political subdivision of the State, including any board of a community college, or an agency, commission, or authority of a political subdivision of the State."

Sec. 2.  G.S. 143-64.14 reads as rewritten:

"§ 143-64.14. Application of Article.

The provisions of this Article shall not apply to municipalities or counties, nor to any agency or department of any municipality or county; provided, however, this Article shall apply to any board of a community college.  Community college is defined in G. S. 115D-2(2)."

Sec. 3.  This act is effective upon ratification and applies to design contracts or design and construction contracts entered into after that date for the construction of a community college facility or the renovation of a major community college facility.
