HOUSE BILL 470

 

AN ACT TO CLARIFY THAT ADMINISTRATIVE COSTS OF COLLECTING THE OCCUPANCY TAX IN CERTAIN COUNTIES SHALL BE PAID FROM THE PROCEEDS OF THE TAX.

 

The General Assembly of North Carolina enacts:

 

Section 1.  Subsection 1(e) of Chapter 969 of the 1985 Session Laws (Regular Session 1986) reads as rewritten:

"(e)      Use of Tax Revenue.  Except as provided in Section 2 of this act for Durham County, a taxing county shall place revenue collected from the net proceeds of a tax levied under this act in a special Travel and Tourism Fund.  Revenue in this Fund may be used only to promote travel and tourism in the county.  As used in this subsection, "net proceeds" means gross proceeds less the cost to the county of administering and collecting the tax, as determined by the finance officer."

Sec. 2.  This act applies only to the following counties:  Clay, Graham, Jackson, and Macon.

Sec. 3.  This act is effective upon ratification.
