AN ACT AUTHORIZING THE COURT TO ORDER DIRECT PAYMENT FOR FEES FOR APPOINTED COUNSEL.

 

The General Assembly of North Carolina enacts:

 

Section 1.  G.S. 15A-1343(e) is amended by adding at the end of that subsection the following new sentence:

"With the consent of the appointed counsel, the court may order that payments for the cost of that counsel be made to the clerk of superior court on behalf of the counsel; the clerk must promptly pay to the appointed counsel any money received on his behalf."

Sec. 2.  G.S. 7A-455(b) is amended by deleting the period at the end of the last sentence of that subsection and by inserting in its place the following:

", but counsel fees ordered paid to the clerk on behalf of the appointed counsel pursuant to G.S. 15A-1343(e) may be paid directly to the counsel."

Sec. 3.  This act is effective upon ratification and shall expire July 1, 1985.
