AN ACT TO PROVIDE A MEANS TO CLEAN UP OIL DISCHARGES.

 

The General Assembly of North Carolina enacts:

 

Section 1.  G S 143-215.84 as the same appears in the 1974 Supplement to Volume 3C of the General Statutes, is hereby amended by adding new subsections to read as follows:

"(c)       The Secretary of the Department of Transportation is authorized and empowered, after consultation with the Secretary of Natural and Economic Resources, to purchase and equip a sufficient number of trucks designed to carry out the provisions of subsection (b). These trucks shall be maintained by the Department of Transportation and shall be strategically located at various locations throughout the State so as to furnish a ready response when word of an oil discharge has been received. The Secretary of the Department of Natural and Economic Resources or his designee will, after consultation, decide where the trucks are to be located.

(d)        The Secretary of the Department of Transportation and the Secretary of the Department of Natural and Economic Resources or their designees shall prepare rules and regulations and develop procedures for the placement of these trucks and shall determine the manner and way in which they are to be used. The Secretary of the Department of Natural and Economic Resources shall reimburse the Department of Transportation for expenses incurred by the Department of Transportation during cleanups as provided in G.S. 143-215.88."

Sec. 2.  The Department of Transportation is hereby authorized to utilize funds in that Department's "Equipment Fund" to purchase trucks and administer the placement of those trucks throughout the State pursuant to the provisions of this act. The Director of the Budget is hereby authorized to transfer funds from other highway fund sources to the "Equipment Fund" in sufficient amounts to meet the expenses incurred through this act in 1975-1977 biennium up to three hundred thousand dollars ($300,000).

Sec. 3.  This act shall become effective on July 1, 1975.
