AN ACT TO PROVIDE FOR A CLASSIFICATION OF "EXEMPT" SUBSTANCES UNDER THE NORTH CAROLINA CONTROLLED SUBSTANCES ACT.

 

The General Assembly of North Carolina enacts:

 

Section 1.  G.S. 90-88 is hereby amended by adding a new subsection (g) as follows:

"(g)       The North Carolina State Board of Health shall similarly exempt from the provisions of this Article any chemical agents and diagnostic reagents not intended for administration to humans or other animals, containing controlled substances which either (1) contain additional adulterant or denaturing agents so that the resulting mixture has no significant abuse potential, or (2) are packaged in such a form or concentration that the particular form as packaged has no significant abuse potential, where such substance was exempted by the Federal Bureau of Narcotics and Dangerous Drugs."

Sec. 2.  This act shall become effective upon ratification.
