AN ACT TO AMEND THE CHARTER OF THE TOWN OF SYLVA TO REGULATE THE PRESENTATION OF CLAIMS.

 

The General Assembly of North Carolina enacts:

 

Section 1. Chapter 72, Private Laws of 1899, is amended by adding a new section, to be designated Section 29, to read:

"Sec. 29. All claims or demands against the Town of Sylva arising in tort shall be presented to the governing body of the town or the Mayor, in writing, signed by the claimant, his attorney or agent, within sixty (60) days after the claim or demand is due or the cause of action arose. No suit or action shall be brought within ten (10) days or after the expiration of twelve (12) months from the time the claim is presented. If the claim is not presented within sixty (60) days after the claim or demand is due or the cause of action arose, and if suit is not instituted within twelve (12) months thereafter, the claim and action thereon shall be barred."

Sec. 2. This act shall apply to claims and actions arising after the ratification of this act.

Sec. 3. This act is effective upon ratification.
