AN ACT TO AMEND G. S. 67-12 SO AS TO AUTHORIZE THE BOARD OF COUNTY COMMISSIONERS OF FORSYTH COUNTY TO REGULATE DOGS RUNNING AT LARGE AND UNACCOMPANIED BY THE OWNER OR BY SOME MEMBER OF THE OWNER'S FAMILY OR BY SOME OTHER PERSON WITH THE OWNER'S PERMISSION.

 

The General Assembly of North Carolina do enact:

 

Section 1. G. S. 67-12 is amended by adding at the end thereof the following:

"The Board of County Commissioners of Forsyth County may, upon making a finding that it is necessary for the protection of the public health and the general welfare of the county to regulate dogs running at large, adopt a resolution making it unlawful for any owner of a dog to allow the dog to run at large unaccompanied by the owner, or by some member of the owner's family, or some other person with the owner's permission, unless the said dog is wearing a muzzle. Any person intentionally, knowingly, and wilfully violating the said resolution shall be guilty of a misdemeanor, and upon conviction shall be fined not exceeding fifty dollars ($50.00) or imprisoned not exceeding 30 days; and shall also be liable in damages to any person injured or suffering loss to his property or chattels.

"Further, the Board of County Commissioners is hereby authorized to adopt a resolution authorizing any law enforcement officer, dog warden, or rabies control officer to pick up any dog found to be in violation of any of the laws of the State of North Carolina or any resolution of the Board of County Commissioners relating to the control of stray or lost dogs running at large unaccompanied by the owner, some member of the owner's family, or some person with the owner's permission, and to impound said dog in a dog pound provided for that purpose. The resolution of the Board of County Commissioners may spell out the procedure to be followed upon such impounding, which shall include a provision giving notice of said impoundment, authorizing the owner of the dog to pick the same up upon payment of fees fixed by the Board of County Commissioners, and providing for the humane destruction of said dog if said dog is not claimed by the owner or by some other person willing to pay the fees and to provide the dog with a proper home."

Sec. 2. This Act is to be deemed to be supplemental and in addition to all other laws relating to the control of dogs. Otherwise, all laws and clauses of laws in conflict herewith are hereby repealed.

Sec. 3. This Act shall apply to Forsyth County only.

Sec. 4. This Act shall be in full force and effect from and after its ratification.
