AN ACT TO PROVIDE FOR RIGHTS OF ACTION FOR DOMICILARIES OF NORTH CAROLINA DAMAGED IN STATES DENYING SUCH RIGHTS OF ACTION ALTHOUGH ALLOWED UNDER NORTH CAROLINA LAW.

 

The General Assembly of North Carolina do enact:

 

Section 1.  A husband and wife shall have a cause of action against each other to recover damages for personal injury, property damage or wrongful death arising out of acts occurring outside of North Carolina, and such action may be brought in this State when both were domiciled in North Carolina at the time of such acts.

Sec. 2.  All laws and clauses of laws in conflict with this Act are hereby repealed.

Sec. 3.  This Act shall be effective upon its ratification.
