AN ACT TO AMEND CHAPTER 93A OF THE NORTH CAROLINA REAL ESTATE LICENSING BOARD, THE QUALIFICATIONS OF REAL ESTATE BROKERS, AND THE GROUNDS FOR REVOCATION OF LICENSES.

 

The General Assembly of North Carolina do enact:

 

Section 1.  Subparagraph (a) of Section 93A-3 of the General Statutes is amended by striking therefrom in line 4 the word "only" following the word "that" and preceding the word "two".

Sec. 2.  Subparagraph (a) of Section 93A-4 of the General Statutes is amended by adding in line 4 after the period marking the end of the sentence ending with the word "Board" and before the sentence beginning with the word "Each" the following:

"Each applicant for a license as a real estate broker shall be a citizen of the United States and shall be at least 21 years of age. Each applicant for a license as a real estate broker shall have been actively engaged as a licensed real estate salesman in this State for at least six months prior to making application for a license as a real estate broker, or shall furnish evidence satisfactory to the Board of experience in real estate transactions or the completion of a study or a combination of experience and study of real estate transactions which the Board shall find equivalent to such six months experience as a licensed real estate salesman."

Sec. 3.  Subparagraph (a) of Section 93A-6 of the General Statutes is amended by adding in line 9 following the word "license" and before the word "or" a comma and the following:

"or has been convicted or has entered a plea of nolo contendere upon which a finding of guilty and final judgment has been entered in a court of competent jurisdiction in this State or in any other state of the criminal offense of embezzlement, obtaining money under false pretenses, forgery, conspiracy to defraud or any similar offense or offenses involving moral turpitude."

Sec. 4.  All laws and clauses of laws in conflict with this Act are hereby repealed.

Sec. 5.  This Act shall be in full force and effect from and after July 1, 1967.
