AN ACT TO AMEND CHAPTER 678 OF HOUSE BILL NO. 308 OF THE 1949 SESSION LAWS OF NORTH CAROLINA RELATING TO PEACE OFFICERS' RELIEF FUND FOR THE COUNTY OF BEAUFORT TO BE HEREAFTER KNOWN AS THE BEAUFORT COUNTY LAW ENFORCEMENT OFFICERS' ASSOCIATION.

 

The General Assembly of North Carolina do enact:

 

Section 1. Short Title. That this Act shall hereafter be known and may be cited as the Beaufort County Law Enforcement Officers' Association.

Sec. 2. Definitions. Law enforcement officers shall be deemed to include all active and retired law enforcement officers with power of arrest of the County of Beaufort, North Carolina, or subdivisions thereof including all cities and towns and members of the State Highway Patrol, who are required by the terms of their employment or elections to give their full time to the preservation of public order, the protection of life and property, and the detection of crime.

Sec. 3. Creation of Association. An association to be known and designated as the Beaufort County Law Enforcement Officers' Association shall be formed, the membership of which shall include all law enforcement officers in Beaufort County and the members of the State Highway Patrol as defined above. Membership shall be governed by the bylaws drawn up and approved by the association.

Sec. 4. Registration. Law enforcement officers who are entitled to membership in the association, in order to share in the benefits provided for in this Act, shall make application for membership in the association on blanks to be furnished for that purpose, giving such information as may be required by said association, and shall pay an initiation fee to be fixed by the Executive Board. Any officer making application for membership in said Beaufort County Law Enforcement Officers' Association shall not be eligible for membership until they have served as a law enforcement officer in the County of Beaufort for a period of six months. After submitting application, membership in said association will require a majority vote of members present.

Sec. 5. Creation of Executive Board. The Executive Board shall consist of five members of the association, in good standing, provided that not more than one officer from any agency shall serve during the calendar year, to be elected by a majority vote of said association at the last regular meeting in June of each calendar year, such board members to assume their duties on the first day of July and to hold office until their successors are elected and qualify. The said board shall elect a chairman and secretary at its first meeting in each year. A majority of members of said Executive Board shall constitute a quorum for the transaction of business.

Sec. 6. Treasurer. The County Treasurer of Beaufort County shall be ex officio treasurer of said association.

Sec. 7. Ladies Auxiliary. There shall be a Ladies Auxiliary of the Beaufort County Law Enforcement Officers' Association. This Auxiliary shall include wives of active members of said association. The rules and bylaws of the Ladies Auxiliary will require approval of the Executive Board of the Beaufort County Law Enforcement Association.

Sec. 8. Application of Fund. The money so paid into the hands of the Treasurer of the Beaufort County Law Enforcement Officers' Association shall be turned over to the County Treasurer of Beaufort County to be disbursed at the approval of the Executive Board.

Sec. 9. Annual Reports. The treasurer of said association shall make annual reports to the Executive Board prior to the meeting of said association in June of each calendar year showing the total amount of money in his hands at the time of the filing of the report, and also an account of receipts and disbursements since his last report. The chairman of said Executive Board shall present such reports to the membership of the association at each annual meeting in June. The accumulated funds of the association may be invested in bonds and securities unanimously approved by the Executive Board. All interest and other income received from investment or deposits shall be added to the principal of said fund. Expenditures shall only be made upon vouchers properly signed by the chairman of the Executive Board, and the treasurer.

Sec. 10. Salaries and Expenses. All officers and members of the Executive Board shall serve without compensation. Necessary office supplies and stationery shall be paid for out of the funds of the association.

Sec. 11. Constitution and Bylaws. The Beaufort County Law Enforcement Officers' Association shall adopt a constitution and bylaws, to be approved by the Executive Board, suitable for carrying out the provisions and purposes of this Act.

Sec. 12. Use of Property. Any real or personal property owned by the association shall not be available to any civic, church, individual, or groups of individuals without the approval of the Executive Board. Following approval of use by any group by the Executive Board it shall be required the presence when so used, of at least one active member of the Beaufort County Law Enforcement Officers' Association. Their property shall not be made available for any political function.

Sec. 13. Funds not Taxable. The current or accumulated funds or real and personal property of the association shall not be subject to State, county or municipal taxation.

Sec. 14. All laws and clauses of laws in conflict with this Act are hereby repealed.

Sec. 15. This Act shall be in full force and effect from and after its ratification.
