AN ACT TO APPROVE AND CONFIRM CONTRACTS BETWEEN THE CITY OF RALEIGH AND THE TOWN OF CARY AND BETWEEN THE CITY OF RALEIGH AND THE TOWN OF GARNER WITH REGARD TO THE PURCHASE OF WATER FROM RALEIGH BY SAID TOWNS.

 

The General Assembly of North Carolina do enact:

 

Section 1. That notwithstanding any other general or special laws, or any charter provisions of the Town of Cary, the Town of Garner or the City of Raleigh, that certain agreement dated the 1st day of March, 1966, by and between the City of Raleigh and the Town of Cary as recorded in Book 1707, page 62, in the Office of the Register of Deeds for Wake County, North Carolina, and that certain agreement dated the 21st day of February, 1967, by and between the City of Raleigh and the Town of Garner as recorded in Book 1756, page 57, in the Office of the Register of Deeds for Wake County, North Carolina, which agreements stipulate the terms and conditions under which water service will be furnished by the City of Raleigh to the Town of Cary and to the Town of Garner respectively, be and the same are hereby confirmed and declared valid and binding agreements respectively between the City of Raleigh and the Town of Cary and the City of Raleigh and the Town of Garner, the terms of said agreements being incorporated herein by reference as is set forth fully herein.

Sec. 2. No action based upon the invalidity of the contracts herein confirmed shall lie to enjoin the issuance of, or to contest, any bonds authorized by the Town of Cary, the Town of Garner or the City of Raleigh to implement their respective contracts.

Sec. 3. All laws and clauses of laws in conflict with this Act are hereby repealed.

Sec. 4. This Act shall be in full force and effect from and after its ratification.
