AN ACT TO REWRITE G.S. 146-24 (c) TO AUTHORIZE THE DEPARTMENT OF ADMINISTRATION TO ACQUIRE LAND BY CONDEMNATION IN THE MANNER DESCRIBED BY ARTICLE 9 OF CHAPTER 136 OF THE GENERAL STATUTES OF NORTH CAROLINA.

 

The General Assembly of North Carolina do enact:

 

Section 1.  G.S. 146-24(c) is hereby rewritten to read as follows:

"(c)       If negotiations for the purchase of the land are unsuccessful, or if the State cannot obtain a good and sufficient title thereto by purchase from the owners, then the Department of Administration may request permission of the Governor and Council of State to exercise the right of eminent domain and acquire any such land by condemnation in the same manner as is provided for the State Highway Commission by Article 9 of Chapter 136 of the General Statutes. Upon approval by the Governor and Council of State, the Department may proceed to exercise the right of eminent domain. Approval by no other State agency shall be required as a prerequisite to the exercise of the power of eminent domain by the Department.

Sec. 2.  All laws and clauses of laws in conflict with the provisions of this Act are hereby repealed.

Sec. 3.  This Act shall not apply to pending litigation.

Sec. 4.  This Act shall be in full force and effect from and after the date of its ratification.
