AN ACT TO REPEAL CHAPTER 513 OF THE SESSION LAWS OF 1951, AND TO PROVIDE FOR THE ELECTION OF MEMBERS OF THE BOARD OF TRUSTEES OF THE SANFORD GRADED SCHOOL DISTRICT.

 

The General Assembly of North Carolina do enact:

 

Section 1. The Board of Trustees of Sanford Graded School District, Lee County, shall consist of seven members, serving staggered six-year terms; that the present members of said Board of Trustees shall hold office until their terms of office respectively expire in accordance with previous elections, and the terms of the present members of said Board of Trustees are hereby ratified and confirmed.

Sec. 2. Regular elections to the Board of Trustees of the Sanford Graded School District shall be held biennially on the second Saturday after the first Monday in May, beginning in 1967. At the municipal election to be held in the City of Sanford on the second Saturday after the first Monday in May 1967, there shall be elected by the qualified voters of the Sanford Graded School District three Trustees to serve for a term of six years; and at said election on the second Saturday after the first Monday in May 1969, there shall be elected two Trustees of said School District to serve for a term of six years; and at said election on the second Saturday after the first Monday in May 1971, there shall be elected two Trustees to serve for a term of six years; and thereafter as their terms respectively expire their successors shall be elected for a term of six years.

The Trustees so elected shall be inducted into office on July 1 next following their election, unless said date falls on Sunday, in which event said Trustees shall be inducted into office on the following Monday.

Sec. 3. Each qualified person who would offer himself as a candidate for the Board of Trustees of the Sanford Graded School District shall file with the Board of Elections of Lee County a written statement giving notice of his candidacy. Such statement shall be filed not earlier than the ninth Monday and not later than five o'clock P.M. on the fifth Monday preceding the election at which he offers his candidacy, shall be accompanied by a filing fee of five dollars ($5.00), and shall be in substantially the following form:

"I, ___________________________________, do hereby give notice that I am a candidate for the election of the Board of Trustees of the Sanford Graded School District to be voted upon at the election to be held on________________________, and I hereby request that my name be placed on the official ballot for such office. I certify that I am a resident and qualified voter of the Sanford Graded School District, residing at ___________________.

Sec. 4. The Board of Elections of Lee County shall conduct all Sanford Graded School District elections, including regular elections, bond elections, and any other authorized special elections. Except as otherwise provided in this Act or as otherwise provided in general or local Acts relating to bond elections, tax elections or other special elections in the Sanford Graded School District, all Sanford Graded School District Elections shall be conducted under the laws, rules, and regulations governing the conduct of General Elections in Lee County. The Board of Trustees of the Sanford Graded School District are hereby authorized to reimburse Lee County for the actual costs of conducting each election for the Sanford Graded School District.

Sec. 5. In conducting elections for the Sanford Graded School District, the Board of Elections of Lee County shall use the registration books of Lee County, and all persons now or hereafter duly registered in such registration books, who live within the Sanford Graded School District, shall be entitled to vote in all Sanford Graded School District Elections.

Sec. 6. Chapter 513 of the 1951 Session Laws is hereby repealed and all laws and clauses of laws in conflict with the provisions of this Act are hereby repealed, but such repeal shall not be construed as reviving any laws in conflict herewith.

Sec. 7. This Act shall be in full force and effect from and after its ratification.
