HOUSE BILL 1413

 

 

AN ACT TO AUTHORIZE THE TOWN OF CHAPEL HILL TO EXCHANGE CERTAIN REAL ESTATE.

 

WHEREAS, the Town of Chapel Hill acquired certain real estate from John W. Umstead, Jr. and wife, Sally R. Umstead, by deed recorded in Deed Book 131 at Page 326, Orange County Registry, for use for cemetery purposes; and

WHEREAS, a small portion of said real estate was so used, but that the remainder thereof is not now necessary nor its use contemplated or desirable for such purposes; and

WHEREAS, the Town of Chapel Hill is desirous of acquiring certain real estate adjoining property it now owns and uses for recreational purposes; and

WHEREAS, said real estate is owned by John W. Umstead, Jr., or a corporation owned or controlled by him; and

WHEREAS, the said John W. Umstead, Jr. has indicated a willingness to exchange the real estate adjoining the land owned by the Town of Chapel Hill in exchange for the conveyance of so much of the real estate presently owned by the Town, and acquired as aforesaid for cemetery purposes, but no longer required for such use: Now, therefore,

 

The General Assembly of North Carolina do enact:

 

Section 1. The Town of Chapel Hill is hereby authorized and empowered to convey to John W. Umstead, Jr., or a corporation designated by him, the land owned by it and described as follows:

All that certain tract or parcel of land situate, lying and being in Chapel Hill Township, Orange County, North Carolina, a short distance North of the Town of Chapel Hill, North Carolina and BEGINNING at an iron stake and Gum pointers in the eastern line of the right-of-way of State University Railroad Company and in J. C. Merritt heirs line; running thence with the said Merritt heirs line South 88 degrees East 616 feet to an iron stake and Walnut pointers and which point is 30 feet from the center of the power line right-of-way; running thence North 21 degrees East and parallel with the center line of the power line right-of-way 533 feet to an iron stake; running thence North 88 degrees West 1,198 feet to an iron stake in the said Railroad Company's rigbt-of-way; running thence along the Eastern line of said railroad company's right-of way; running thence along the eastern line of said railroad company's right-of-way South 36 degrees East 650 feet to the BEGINNING; except that portion of said land described as follows: BEGINNING at an iron stake and Gum pointers in the eastern line of the right-of-way of the State University Railroad Company and in J. C. Merritt heirs line; running thence with said Merritt heirs line South 88 degrees East 250 feet; running thence North 88 degrees West 400 feet to the eastern right-of-way of University Railroad; running thence along the eastern line of said railroad company's right-of-way South 36 degrees East 250 feet to the BEGINNING,

In exchange for real estate described as follows:

BEGINNING on the southern right-of-way line of Umstead Drive at the northeast corner of the Exchange Club Pool, Inc. property, as shown on Orange County Tax Map #30, Lot No. 7; then with the eastern line of Lot No. 7 South 22 degrees West about 440 feet to the center of Bolin Creek; then downstream with the center of Bolin Creek in a southeasterly direction about 300 feet to its junction with Tanyard Branch; then upstream along the center of Tanyard Branch in a southwesterly direction about 500 feet to the southern property line of the Umstead property; then with said line South 89 degrees 30 feet East about 1,140 feet to a property corner; then along a property line North 4 degrees West about 780 feet to the center of Bolin Creek; then downstream with the center of Bolin Creek in a northeasterly direction about 2,050 feet to a property corner; then North 13 degrees East along a property line about 100 feet to the southern right-of-way line of Umstead Drive; then along the southern right-of-way line of Umstead Drive in a southwesterly direction about 2,700 feet to the point of BEGINNING.

Sec. 2. All laws and clauses of laws in conflict with this Act are hereby repealed.

Sec. 3. This Act shall be in full force and effect from and after its ratification.
