SENATE BILL 91

 

 

AN ACT TO AUTHORIZE USE OF PROTECTIVE PAYMENTS IN CERTAIN AID TO DEPENDENT CHILDREN CASES.

 

The General Assembly of North Carolina do enact:

 

Section 1.  Article 3 of Chapter 108 of the General Statutes of North Carolina is hereby amended by adding a new Section at the end thereof to be numbered § 108-76.6 and to read as follows:

"§ 108-76.6.  Protective Payments in ADC Cases. In addition to the use of personal representatives as authorized in G.S. 108-76.3 through G.S. 108-76.5, the State Board of Public Welfare is to adopt rules and regulations providing for the use of protective payments to the extent authorized by Title IV of the Federal Social Security Act, when it is determined that the payee in an aid to dependent children case fails to use the assistance funds for the purpose for which they were intended."

Sec. 2.  All laws and clauses of laws in conflict with this Act are hereby repealed.

Sec. 3.  This Act shall be in full force and effect from and after its ratification.
