AN ACT TO TAX CERTAIN COURT COSTS IN LINCOLN COUNTY FOR THE BENEFIT OF THE LINCOLN COUNTY MEMORIAL LIBRARY.

 

The General Assembly of North Carolina do enact:

 

Section 1. In order to provide a fund for the extension, maintenance and support of the Lincoln County Memorial Library the sum of one dollar ($1.00) shall be taxed as costs and collected by the Clerk of the Superior Court in each and every case tried and disposed of in the Superior Courts of Lincoln County after the effective date of this Act, except in cases in which said county is adjudged to pay all costs, and shall be set apart in a fund to be known and designated as a library fund, and said fund shall be deposited by the Clerk of the Superior Court in a bank designated for that purpose, and shall be used solely for the purpose of the extension, maintenance and operation of the said library.

Sec. 2. It shall also be the duty of the Clerk of the Recorder's Court of Lincoln County, after the effective date of this Act, to collect from the defendant in each and every case finally disposed in his court, except in cases in which Lincoln County is adjudged to pay all costs, the sum of one dollar ($1.00) which amount shall be immediately paid over to the Clerk of the Superior Court of Lincoln County to supplement the aforesaid library fund.

Sec. 3. The funds herein provided for shall be used for the support and maintenance of the Lincoln County Memorial Library.

Sec. 4. All laws and clauses of laws in conflict with this Act are hereby repealed.

Sec. 5. This Act shall become effective July 1, 1961.
