AN ACT TO PROVIDE FOR STAGGERED TERMS OF OFFICE FOR MEMBERS OF THE BOARD OF EDUCATION IN NASH COUNTY.

The General Assembly of North Carolina do enact:

Section 1. Section 4 of Chapter 738 of the Session Laws of 1955 is hereby rewritten to read as follows:

"Sec. 4. In the general election to be held in the year 1960, five members shall be elected to the Board of Education of Nash County, three members to be elected for terms of four years each and two members to be elected for terms of two years each. The three candidates receiving the highest number of votes shall be declared elected for the four-year terms and the two candidates receiving the next highest number of votes shall be declared elected for the two-year terms. Provided, however, that if there is held a primary election in said county in the year 1960 in which five members of the board of education are nominated, and the five members nominated in said primary are the same as the five members elected in said general election of 1960, the three candidates receiving the highest number of votes in said primary shall, after the general election, be declared elected for the four-year terms and the two candidates receiving the next highest number of votes in said primary shall, after said general election, be declared elected for the two-year terms. In the event a tie vote makes it impossible to determine which candidate or candidates have been elected for the four-year terms, the tie shall be broken by the drawing of lots. At the expiration of the terms of members elected in 1960, successors shall be elected for terms of four years each and until their successors are duly elected and qualified."
